Terms & Conditions of Service
This agreement (the "Agreement") is entered into by and between you ("you") and Wine Science Ltd, of 30 Lincoln Road, Birmingham B27 6PA, (hereinafter referred to as "Wine Science") regarding your use of the Wine Science News service (hereinafter referred to as the "Service").
By using the Service, you are entering into this Agreement with Wine Science and indicating that you agree to be bound by these terms and conditions. If you do not agree with these terms and conditions as stated, please do not use the Service.
1. Priority
This Agreement, in combination with Wine Science’s Privacy Policy (available at www.winesciencenews.com/privacy), sets forth the terms and conditions under which Wine Science makes the Service available to you. In case of inconsistency between this Agreement and Wine Science’s Privacy Policy, this Agreement shall prevail.
2. Rights Associated with the Service
The service has been designed to help you find information that resides on sites over which Wine Science has no ownership or control. In particular, the Service may from time to time provide brief descriptions of items listed to help you identify items of interest to you. When you select an item, you will be re-directed to the source where the full text of the item appears. Wine Science owns and retains all intellectual property rights to the Service; but Wine Science does not claim ownership rights to the target items, owned by the sites to which the Service links.
3. Objectionable Content
The items displayed and linked to by the Service are published by sites over which Wine Science has no control. These items are indexed by Wine Science computers. While Wine Science does screen items it receives from target sites to the best of its abilities before publishing them on the Wine Science News site, the Service may display items and links to sites that some people may find objectionable, inappropriate, or offensive. While Wine Science does not guarantee that a Wine Science News page will not include unintended or objectionable content, should you come across such an item, please contact us to have it removed. While Wine Science will do its utmost to remove the offending item, Wine Science does not assume responsibility for the content of any site from which an item is featured or linked to by the Service.
4. Use of the Service
You may only display the content of the Service for non-commercial use, and may not otherwise copy, reproduce, alter, modify, create derivative works from the items provided to you by the Service without seeking prior permission from the original publisher of the item you wish to use. If you are uncertain whether your intended use of the service is acceptable, please contact us. Wine Science reserves the right to suspend or terminate the Service or your access to it at its sole discretion.
5. Disclaimer & Limitations of Liability
5.1 By using the Service you waive the right to hold Wine Science responsible or liable for the accuracy, content, completeness, legality, reliability, or availability of the information or material displayed by the Service. Further, you also waive the right to hold Wine Science responsible or liable for the deletion, failure to store, mis-deliver or untimely deliver any information or material.
5.2 By using the service you waive the right to hold Wine Science responsible or liable for any harm resulting from downloading or accessing any information or material from a site featured or linked to by the Service.
5.3 THE SERVICE INCLUDING THE INFORMATION, NAMES, IMAGES, PICTURES, LOGOS AND ICONS REGARDING OR RELATING TO THIRD PARTY PRODUCTS AND SERVICES IS PROVIDED ON AN “AS IS” AND ON AN “IS AVAILABLE” BASIS WITHOUT ANY REPRESENTATIONS OR ANY KIND OF WARRANTIES MADE (WHETHER EXPRESS OR IMPLIED BY LAW) TO THE EXTENT PERMITTED BY LAW, INCLUDING THE IMPLIED WARRANTIES OF QUALITY, FITNESS OF PURPOSE, NON-INFRINGEMENT, COMPATIBILITY, SECURITY AND ACCURACY.
5.4 UNDER NO CIRCUMSTANCES WILL WINE SCIENCE LTD BE LIABLE FOR ANY OF THE FOLLOWING LOSSES OR DAMAGE (WHETHER SUCH LOSSES WHERE FORESEEN, FORESEABLE, KNOWN OR OTHERWISE): (i) LOSS OF DATA, (ii) LOSS OF REVENUE OR ANTICIPATED PROFITS, (iii) LOSS OF BUSINESS, (iv) LOSS OF OPPORTUNITY, (v) LOSS OF GOODWILL OR INJURY TO REPUTATION, (vi) LOSSES SUFFERED BY THIRD PARTIES, OR (vii) ANY INDIRECT, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES ARISING FROM THE USE OF THE SERVICE, REGARDLESS OF THE FORM OF ACTION.
5.5 Under no circumstances shall Wine Science be liable to you on account of your use or misuse of or reliance on the Service.
6. Requests for Removal of Links
Items included in the Service have been identified, indexed and compiled through an automated process and have been published in good faith. Should you wish an item be removed from our index, please contact us and we will endeavour to remove the link from our index and halt the future indexing of the target site.
7. Modifications of Terms
Wine Science reserves the right to modify at any time and without notice the terms of this Agreement. Modifications to this Agreement will be effective immediately upon posting.
8. Intellectual Property
The names, images and logos identifying Wine Science and third parties and their products and services are subject to copyright, design rights and trade marks of Wine Science or third parties. Nothing contained in this Agreement shall be construed as conferring by implication, estoppel or otherwise any license or right to use any trademark, patent, design right or copyright of Wine Science or any other third party.
9. General
9.1 If any item or items within this Agreement are deemed to be illegal, invalid, or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from this Agreement and the remaining items shall survive, remain in full force and effect and continue to be binding and enforceable.
9.2 By agreeing to the terms of this Agreement you agree that this Agreement shall be governed in accordance with the laws of England and Wales.
